Prayer : Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, praying to direct the Respondents 1 and 2 not to harass the Petitioner in the name of enquiry.

ORDER

The learned Counsel for the Petitioner submitted that the Petitioner had filed this petition seeking direction against the Respondent Police not to harass the Petitioner under the guise of an enquiry.

2. The learned Counsel for the third Respondent also appeared before this Court and submitted that there was a dispute between the parties regarding money transaction for more than Rs.40,00,000/-.

3. The learned Additional Public Prosecutor on instructions from the Respondents 1 and 2 would submit that based on the complaint of the third Respondent, the case was taken as current paper in N.Ref.N4/27576/1734/G/2024 dated 20.12.2023 and the same is pending. He would further submit that the Respondent Police undertakes to follow the circular issued by the Director General of Police, Tamil Nadu / Head of State Police Force and the Additional Director General of Police, Law and Order, Tamil Nadu, directing the Field Officers throughout the State of Tamil Nadu not to involve themselves in the civil dispute particularly involving money dispute and property dispute.

4. Recording the submission of the learned Additional Public Prosecutor, this Criminal Original Petition is closed with a direction to the third Respondent to approach the competent Civil Court for appropriate relief and not to pressurize the Police for taking action. The Respondent Police are directed to follow the circular stated supra.
