O R D E R
The present Writ Petition has been filed seeking a Mandamus forbearing the second respondent from changing the name in the Electricity Service Connection from that of the petitioner to the names of respondents 3 to 5 or any other person, pending finality of the proceedings in Na.Ka. No. 3776/A4/2025 on the file of the first respondent.
2. Admittedly, the petitioner is the original owner of the property. He had executed a Settlement Deed dated 16.09.2014 in favour of respondents 3 to 5. Subsequently, the petitioner filed O.S. No.244 of 2023 before the learned VI Additional District Court, Madurai, seeking to set aside the said Settlement Deed and for a consequential permanent injunction restraining the defendants therein from disturbing his possession. The said suit is pending. 2/6

The petitioner had also approached the first respondent under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, seeking cancellation of the Settlement Deed dated 16.09.2014. The first respondent, by order dated 16.02.2026, rejected the said application on the ground that the petitioner had not completed 60 years of age and, therefore, was not a "senior citizen" within the meaning of the Act.
4. It is the contention of the petitioner that until the proceedings before the first respondent attain finality, the electricity service connection should not be mutated in favour of respondents 3 to 5.

The learned counsel appearing for respondents 3 to 5 submitted that all the revenue records and property tax receipts had already been transferred in their names as early as in the year 2014, pursuant to the Settlement Deed. It is further submitted that in view of the rejection of the petitioner's application by the first respondent on 16.02.2026, there is no legal impediment for the second respondent to effect mutation of the electricity service connection in favour of respondents 3 to 5.

6. Considering the fact that the application filed by the petitioner under the Senior Citizens Act has already been disposed of on 16.02.2026, and that the civil suit in O.S. No.244 of 2023 seeking to set aside the Settlement Deed is pending before the learned VI Additional District Court, Madurai, this Court is inclined to pass the following order: (a) The second respondent is at liberty to proceed in accordance with law.
(b) Any transfer of the electricity service connection in the names of respondents 3 to 5 shall be subject to the result of O.S. No.244 of 2023 pending on the file of the learned VI Additional District Court, Madurai. (c) The petitioner is at liberty to approach the appropriate Appellate Tribunal, if so advised, challenging the order of the first respondent dated 16.02.2026.
7. With the above observations, this Writ Petition stands disposed of. No costs.
