ORDER

Seeking transfer of investigation in Crime No.252 of 2023 on the file of the third respondent police to the file of the fourth respondent or any other competent investigating agency, this criminal original petition is filed.

2.The learned counsel for the petitioner submitted that the petitioner, who is the defacto complainant, has lodged a complaint before the third respondent police on 05.09.2023, following which, first information report in Crime No.252 of 2023 was registered for the offences under Sections 294(b), 420, 468, 474 and 506(2) IPC and Section 21(1) of Mines and Minerals (Development and Regulation) Act, 1957, as against six persons. However, there is no progress in the investigation. Hence, this petition.

3.The learned Government Advocate (Crl.side), on instructions, submitted that in this case investigation has been completed and referred charge sheet has been filed as 'Mistake of Fact' and main number is yet to be assigned.

4.In view of the above, the third respondent police is directed to serve the referred chare sheet to the petitioner and the petitioner is given liberty to file a protest petition, if so adviced. 5.With the above direction, this Criminal Original Petition is disposed of.
