ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused Nos.1 and 4, apprehend arrest at the hands of the respondent Police for the alleged offences punishable under Sections 376 and 506(ii) IPC in Crime No.15 of 2015 on the file of the respondent Police and hence, seek anticipatory bail. 2.According to the de-facto complainant that she was having love affairs with the 1st accused and also had physical relationship with him believing his false promise to marry her and as a result, she has become pregnant. However, the 1st refused to marry her. 3.

The learned counsel for the petitioners submitted that the petitioners are innocent persons and they have been falsely roped in this case. It is further submitted that A2 was granted anticipatory bail in Crl.O.P.(MD)No.16603 of 2015 by this Court and A3 was arrested and released on bail by the Principal Sessions Judge, Dindigul in Cr.M.P.No.2224 of 2015.

4.Heard the learned Government Advocate (Crl.side) appearing for the respondent Police submitted that the 1st accused in now secured and remanded to judicial custory on 13.10.2015.

5.Considering the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the 2nd petitioner, with certain conditions. Accordingly, the 2nd petitioner is ordered to be released on bail in the event of arrest or on their appearance before the learned Judicial Magistrate, Nilakottai, and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the 2nd petitioner shall appear before the respondent police as and when required. The 2nd petitioner shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
