ORDER : The Court Made the following order :- The petitioner, who apprehending arrest at the hands of the respondent police for the offence punishable under Sections 8(c) r/w.20(b)(ii)(B) of NDPS Act, registered in Crime No.126 of 2019, seeks anticipatory bail.
2.The case of the prosecution is that the respondent police conducted a raid along with their party, at that time, the petitioner was in possession of 1.100 kilograms of ganja, for which, the respondent police registered a case against the petitioner. 3.The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution.
4.The learned Additional Public Prosecutor for the respondent police submitted that the alleged quantity of ganja possessed by the petitioner is a commercial quantity. He further submitted that the petitioner is having two previous cases. Hence, he opposed to grant anticipatory bail to the petitioner.
5.Considering the facts and circumstance of the case, considering the nature of the offence committed by the petitioner and taking note of the fact that the petitioner is having two https://hcservices.ecourts.gov.in/hcservices/
previous cases, this Court is not inclined to grant anticipatory bail to the petitioner. Hence, this criminal original petition is dismissed.
