ORDER

One Ramachandran filed W.P.(MD)No.33621 of 2025 for directing the EO of the subject temple to issue receipt in respect of 4th Kala Kattalai in favour of the five villages. I disposed of the writ petition by directing the Joint Commissioner to take a call. Seeking review, this application has been filed. Since there is a delay, condone delay petition has also been filed.

2. I am of the view that the matter can be disposed of at this stage itself. Since there is a dispute between the villagers of Vellankulam on the one hand and the other villagers, as far as this year is concerned, the receipt can be issued in the name of the deity for the 4th kala poojai of the coming Maha Sivarathiri. The villagers from all the five villages namely Vellankulam, Sakkarakulam, Oothangulam, Andarkulam & Uchipothaikulam are entitled to participate on equal basis. It is seen that the writ petitioner and others have already filed O.A.No.15 of 2024 for framing a scheme under Section 64 of the HR & CE Act. It shall be disposed of within a period of eight months. I make it clear that the order passed in this writ petition will be confined only to this year alone and no direction has been given as regards the celebration of Maha Sivarathiri from next year onwards.

3. It appears that a hall has been constructed for the benefit of the devotees near the temple. Unfortunately, on account of the dispute among the five villagers, the hall has not been opened for the use of the devotees. Thiru.Ramachandran / writ petitioner requested the Court to 3/5

direct the EO to open the building. This request is seconded by the learned counsel Mr.R.J.Karthick appearing for the review applicant. The EO has no objection for opening the building. Let the building be opened on 13.02.2026.

4. This Writ Miscellaneous Petition is disposed of accordingly. No costs.
