ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the respondents 1 and 2 to conduct an enquiry and dispose the petitioner's representation dated 05.01.2026 and consequently to direct the respondents 1 and 2 to grant permission to conduct the Kovil Kodai festival of Sri Nondi Karuppasamy Temply, situated at Kanginanginru Village, Kayathar Taluk, Thoothukudi District, scheduled to be held on 15.02.2026 to 17.02.2026. 2/5

2. After hearing the rival submissions, this Court appointed an Advocate Commissioner to conduct an election. It is submitted that the petitioner accepted the voter list suggested by the respondents. After election, it is seen that all 68 persons who cast their votes favoured the petitioner and not the respondents. The same is recorded.

3. However, in order to resolve the dispute, this year alone the respondents are permitted to conduct the festival on 15.02.2026 alone, between 6.00 a.m. and 12.00 p.m. From 12.01 a.m. on 16.02.2026 until 17.02.2026, the petitioner is permitted to conduct the festival. The petitioner is further directed to pay an additional sum of Rs.10,000/- to the Advocate Commissioner.
