ORDER
Seeking the police protection for the purpose of harvesting the Paddy cultivated in the agricultural land belonging to the petitioner, this criminal original petition is filed.
2. The learned counsel for the petitioner submitted that the 3rd respondent is obstructing the petitioner from harvesting the Paddy in his agricultural land.
3. However, the learned counsel for the 3rd respondent submitted that it is the habit of the petitioner to file similar petitions every year at the time of harvest and earlier in the year 2025, the petitioner had approached this Court by filing a writ petition in W.P(MD)No.3324 of 2025 with a similar relief and this Court passed an order dated 10.02.2025 directing the petitioner to take appropriate steps to seek appropriate remedy before the appropriate forum for the civil dispute 2/5
between him and the 3rd respondent. However, again, this petitioner has come before this Court with evasive claims. He further submitted that a civil suit in O.S.No.42 of 2024 on the file of the Subordinate Court at Sankarankovil is already pending in this regard.
4. The learned Government Advocate (Crl.Side) also endorsed the arguments put forth by the learner counsel for the 3rd respondent and submitted that it is for them to work out the remedy before the appropriate civil Court.
5. Heard the learned counsels on either side and perused the materials available on record.
6. It is needless to state that already this Court has clearly directed the petitioner to work out the remedy with respect to the civil dispute to a land comprising an area of 8.80 acres in Survey No.657/1 of Chinthamani Village, Kadayanallur Taluk, Tenkasi District by approaching the appropriate forum. It is made clear that the petitioner 3/5
should not approach this Court any further with similar petitions either next year or thereafter until and unless the civil suit in O.S.No.42 of 2024 on the file of the Subordinate Court at Sankarankovil is finally disposed off and attains finality before the appropriate forum.
7. In view of the above, this Criminal Original Petition stands dismissed.
