ORDER

This petition has been filed to direct the Special Court for Scheduled Casts and Scheduled Tribes (Prevention of Atrocities) Act, 1989, Pudukottai, to accept the surrender of the Petitioners/Accused 1 to 3 and consider their bail application and grant bail on the date of surrender itself in Crime No.13 of 2026 dated 21.01.2026 on the file of 2nd Respondent Police.

2. Considering the nature of the relief sought for, notice to the 3rd respondent is dispensed with.

3. The case of the prosecution is that the first petitioner is the mother and the second petitioner, who is the wife of the third petitioner is the sister of the defacto complainant. On 18.01.2026, the petitioners are said to have attacked the wife of the defacto complainant, who belongs to the schedule caste and abused her in filthy language by calling her caste name and prevented her from collecting sand. Based on these allegations, an FIR has been registered against the petitioners and the same was registered in Crime No.13 of 2021 for the 2/5

offences under Sections 296(b) and 118(1) of BNS r/w 3(1)(r)(s) and 3(2)(va) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Act,2015. Hence, this petition.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

5. Considering the limited scope of the relief sought for, this Court hereby direct the Special Court for Scheduled Casts and Scheduled Tribes (Prevention of Atrocities) Act, 1989, Pudukottai, to issue prior notice to the de facto complainant and thereafter, to consider the bail application of the petitioners on the same day of their surrender before that Court in connection with Crime No.13 of 2026 on the file of the 2nd respondent police.

6. Accordingly, this Criminal Original Petition is disposed of. 06.02.2026 NCC : Yes / No Index : Yes / No dss 3/5
