ORDER

Heard the learned counsel on either side.

2.During the course of the arguments, it is brought to my notice that at the instance of the ninth respondent, this Court in W.P(MD)No.1758 of 2025 has set aside the very same impugned order, which is under challenge in the present proceedings, and the matter has been remitted to the first respondent for conducting fresh enquiry. In the said order, this Court directed the first respondent to hear not only the petitioner, who is the ninth respondent herein, but also all interested persons and their objections. The said exercise has been directed to be completed within a period of twelve weeks from the date of receipt of a copy of that order.

3.In view of the said order, there is no point, in parallel, testing the vires of the impugned proceedings in this writ petition. Therefore, this writ petition is allowed and the impugned order Ni.Mu.No.849907/2023/G5, dated 19.12.2024 passed by the first respondent, is set aside. The parties in the present writ petition are at liberty to agitate all their rights, claims and contentions and make all objections before the first respondent, who has been directed to hear all interested 2/4

parties and pass orders on merits and in accordance with law, pursuant to the enquiry to be conducted as directed by this Court in W.P(MD)No.1758 of 2025, dated 23.01.2025. No costs. Consequently, connected miscellaneous petition is closed.
