ORDER

This Criminal Original Petition has been filed to direct the Special Court for SC/ST(POA) Act cases, Pudukottai, under SC/ST Prevention of Atrocities Act to consider the bail application on the surrender of the petitioners in connection with Crime No.6 of 2026 pending investigation.

2. Considering the nature of the relief sought for, notice to the 3rd respondent is dispensed with.

3. The case of the prosecution is that on 28.01.2026 at about 9.00 a.m., while the defacto complainant was present at his uncle's house, Accused Nos.1 and 2 came to the said place and demanded repayment of an alleged debt. It is alleged that they abused the defacto complainant 2/6

using filthy and caste based derogatory language. Subsequently, the other accused persons are stated to have arrived at the place of occurrence and assaulted the defacto complainant and his relatives with wooden sticks, besides threatening them with dire consequences. Thereafter, the defacto complainant and the other injured persons were admitted to the Government Hospital. Based on the complaint lodged by the defacto complainant, the 2nd respondent police registered F.I.R in Crime No.6 of 2026 for the offences under Sections 191(2), 296(b), 115(2), 324(2) and 351(3) of the BNS, 2023, Section 4 of the Tamil Nadu Prohibition of Harassment of Women Act, 2002, Sections 3(1)(r), 3(1)(s) and 3(2)(va) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendement Act, 2015 and Sections 3 and 4 of the Tamil Nadu Prohibition of Charging Exorbitant Interest Act, 2003.

4. Heard the learned counsel on either side and carefully perused the materials available on record.

Considering the limited scope of the relief sought for, this Court hereby direct the learned Special Court for SC/ST(POA) Act cases, Pudukottai, to issue prior notice to the defacto complainant and thereafter to consider the bail application of the petitioners on the same day of their surrender before that Court in connection with Crime No.6 of 2026 on the file of the 2nd respondent police.
