ORDER : The Court Made the following order :- The petitioner, who is arrayed as A3 in Crime No.491 of 2015 on the file of the respondent police, was arrested on 31.07.2015 for the alleged offences under Sections 341, 294(b) and 302 IPC and hence seeks bail.
2. The case of the prosecution is that the deceased had illicit relationship with the sister of the petitioner and thereafter, the deceased murdered her sister and in a retaliation, the accused are said to have attacked the deceased on 28.07.2015 with lethal weapons and caused his death.
3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. It is further submitted that the deceased was having illicit relationship with so many women and he has been murdered by some other person and the petitioner is implicated only on suspicion.
4.The learned Government Advocate submitted that the specific overt act attributed against this petitioner is that he attacked the deceased in the shoulder and A1, A2, A4 were arrested on 06.08.2015. She would further submit that major part of the investigation is over.
5. Considering the facts and circumstances of the case, I am inclined to enlarge the petitioner on bail on the following conditions. Accordingly, the petitioner is directed to be released on bail on executing a bond for a sum of Rs.10,000/- (Rupees ten thousand only) with two sureties each for a like sum to the satisfaction of the learned https://hcservices.ecourts.gov.in/hcservices/
