Prayer :- Transfer Civil Miscellaneous Petition is filed under section 24 of Civil Procedure Code, to withdraw the case in O.S.No.27 of 2016 pending on the file of the District Munsif cum Judicial Magistrate, Illayangudi Sivagangai District and transfer the same to Learned District Munsif Court, Madurai or any other competent court in Madurai and to pass such further or other order as this Honourable Court ORDER:- Transfer Civil Miscellaneous Petition coming on for hearing on this day and upon perusing the earlier order of this Court made in TR CMP(MD).64 of 2018 dated 07/08/2018 and the requisition letter submitted by the Principal District and Sessions Judge, Sivagangai vide the Letter in D.No.5212 of 2020/HCA dated 21.09.2020 and none appearance of the both the counsels, this Court made the following order:
This petition has been listed today for the extension of time for disposing the suit in O.S.No.27 of 2016.
2. This Court has already disposed of the Transfer Civil Miscellaneous Petition by order dated 07.08.2018, by directing the trial Court to dispose of O.S.No.27 of 2016 within a period of six months.
3.Now, the trial Court seeks further time for disposing the suit since regular Courts could not be conducted owing to Covid-19 https://hcservices.ecourts.gov.in/hcservices/ 1/2
TR CMP(MD). No.64 of 2018 lock-down.
4. Considering the facts and circumstances of the case, further six months' time is granted from the date of receipt of a copy of this order to the trial Court for disposal of O.S.No.27 of 2016. The learned Judge shall dispose of the case within the prescribed time subject to Covid-19 regulations in holding the courts.
