O R D E R

This Transfer Civil Miscellaneous Petition has been filed to transfer the case in H.M.O.P.No.39 of 2017 from the file of the Family Court, Srivilliputhur to the Sub-Court, Kovilpatti, Tuticorin District.

2. The petitioner, who is the wife, has filed this petition for transferring H.M.O.P.No.39 of 2017 from the file of Family Court, Srivilliputhur to the Sub-Court, Kovilpatti, Tuticorin District, on the ground that the petitioner is suffering from renal ailments.

3.The respondent/Husband has filed a counter affidavit stating that the petitioner herein had already filed an interlocutory application in I.A.No.23 of 2018 before the Family Court, Srivilliputhur and obtained an exparte order and by suppressing the said fact, the present petition has been filed. Hence, he prayed this court to dismiss the present transfer petition with costs.

4.Considering the above fact, this Transfer Civil Miscellaneous Petition is dismissed. No costs. However, the Family Court, Srivilliputhur is directed to dispose of H.M.O.P.No.39 of 2017 and I.A.No.23 of 2018 within a period of three months from the date of receipt of a copy of this order. directed to pay a sum of Rs.1,000/- (Rupees one thousand only) to the petitioner for travelling expenses per month without fail. Consequently, connected miscellaneous petitions are closed.
