CORAM
THE HONOURABLE MRS.JUSTICE S.ANANTHI C.R.P(MD)No.249 of 2022 K.C.Ravipalanichamy ... Petitioner/Plaintiff Vs.
1.Natchammal 2.Dr.Vasundra 3.Dharani 4.Natchammal ... Respondents/Defendant PRAYER: Civil Revision Petition filed under Article 227 of the Constitution of India to direct the learned Sub-ordinate Judge, Palani to number the plaint in unnumbered O.S. in D.No.3486 of 2022. For Petitioner :
Mr.K.Arunraj
ORDER
This Revision Petition is filed to direct the learned Subordinate Judge, Palani to number the plaint in unnumbered O.S. in D.No.3486 of 2022.
2. The learned counsel appearing for the petitioner submits that the learned Sub-ordinate Judge, Palani, has rejected the plaint on the ground that the subject matter of the suit is not a registered body, without considering the relevant facts stated in the plaint. Hence, the present Civil Revision Petition has been filed.
3. Heard the learned counsel appearing for the petitioner.
4. It appears that the suit has been filed by the plaintiff in an individual capacity for recovery of money. Hence, no question of returning the plaint that the subject matter of the suit is not a registered body, does not arise and the reason assigned by the learned Sub-ordinate Judge, Palani is not sustainable. Hence, this Court directs the learned Sub-ordinate Judge, Palani to number the plaint, if it is otherwise in order.
5. With these directions, the Civil Revision Petition stands allowed. No costs.
