FOR ANTICIPATORY BAIL IN CRIME NO.57 OF 2024 ON THE FILE OF THE RESPONDENT POLICE.

ORDER : The Court Made the following order :- The petitioners, who apprehend arrest at the hands of the respondent police for the alleged offence under Sections 8(c) r/w 20(b)(ii)(B) of NDPS Act, in Crime No.57 of 2024, seek anticipatory bail.

2. The case of the prosecution is that on 18.01.2024, the respondent Police found the co-accused with possession of 4 kgs of Ganja. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is an innocent person and he has been falsely implicated in this case and he did not commit any offence as alleged by the prosecution. He would further submit the contraband was seized from A3 and not from the petitioners.

4. The learned Government Advocate(Crl.Side) appearing for the respondent Police would submit that the petitioners along with the other accused persons found in illegal possession of 4 kgs of Ganja. He further submitted that 14 previous cases are pending against the petitioners, out of which six cases are similar in nature.

5. Considering the facts and circumstances of the case and also the fact that the petitioners are having 14 previous cases, out of which six cases are similar in nature, this Court is not inclined to grant anticipatory bail to the petitioner. 6.In the result, this Criminal Original Petition is dismissed. sd/- 02/02/2024 / TRUE COPY / /02/2024 Sub-Assistant Registrar ( C.S.
