ORDER : The Court Made the following order :- The petitioner, who is arrayed as A1, in Crime No.357 of 2015 on the file of the respondent police, was arrested and remanded to judicial custody on 08.09.2015, for the alleged offences punishable under Sections Man Missing @ Sections 363, 294(b), 506(i) and 109 of I.P.C., r/w 3(1)(x) of SC/ST Act 1989, and hence, seeks bail.

2.According to the de-facto complainant, on 27.08.2015 at 01.00 p.m., when she was returning home along with her husband, the first accused had taken him to the second accused for a compromise talk and thereafter, he was missing.

3.The learned counsel for the petitioner submitted that the second accused viz., Ganesan and the husband of the de-facto complainant have been involved in so many criminal cases and they committed the offence by using vehicle belonged to the alleged victim and therefore, both A2 and the husband of the de-facto complainant are absconding and it is further submitted that the petitioner is an innocent and he has been incarceration for more than 30 days.

4.The learned Government Advocate (Crl.side) on instruction would submit that as per the statement of the witnesses, the husband of the defacto complainant is alive and a special team has been formed to nab the second accused and to trace the alleged victim. 5.Considering the facts and circumstances of the case, this Court is inclined to grant bail to the petitioner with certain conditions. Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned III Addl. District Judge(PCR) Madurai and on further condition that the petitioner shall report before the respondent Police daily at 10.00 a.m., until further orders.
