ORDER

The above petition is filed by the petitioner seeking relaxation of the condition imposed on him by order dated 03.01.2022 in Crl.MP. (MD).No..11969/2021 in Crl.A.(MD).No.93/2019. 2.The learned counsel for the petitioner submitted that the petitioner was granted the relief of suspension of sentence by this Court on 03.04.2019, in Crl.MP.(MD).No.2227/2019, on condition to should appear before the Court concerned on the first working day of every English Calendar month at 10.30 a.m., pending disposal of the appeal. The learned counsel further submitted that the petitioner complied with the aforesaid condition and filed Crl.MP.(MD).No.11969/2021 for relaxation of the said condition, and this Court, by order dated 03.01.

2022, modified the condition, directing the petitioner to appear before the Court concerned on the first working day of alternative English Calendar month at 10.30 a.m., pending disposal of the appeal, commencing from February 2022. The learned counsel submitted that the petitioner, a senior citizen, is complying with the modified condition imposed by this Court, till date and therefore, prayed for relaxation of the aforesaid condition.

3.The learned Government Advocate [Crl.Side] also affirmed the submissions made by the learned counsel for the petitioner and submitted that the petitioner is complying with the modified condition from February 2022, till date.

4.Heard both sides and perused the materials placed on record. 5.The petitioner, in his affidavit filed in support of the above petition stated that he is a senior citizen, aged about 80 years, orthopaedically handicapped and is suffering from cardological disease apart from being a diabetic. The petitioner further stated that because of his old age and health condition, he is not able to comply with the condition imposed by this Court in the aforesaid order. 6.Considering the age of the petitioner and his health condition, this Court is inclined to relax the condition. 7.Accordingly, the petition is ordered and the condition imposed on the petitioner, by order dated 03.01.2022, in Crl.MP.(MD).No.. 11969/2021 in Crl.A.(MD).No.93/2019, is totally relaxed. 02.02.2026 AP Internet: Yes 3/5
