ORDER

This writ petition has been filed challenging the refusal check slip issued by the respondent dated 06.06.2024 thereby refused to register the rectification dated 06.06.2024 in respect of the property comprised in S.F.No.251/6A & 251/6B, situated at Pithcandarkovil Village, Manachanallur Taluk, Trichirappalli District.

2. By consent of both parties, this writ petition is taken up for final disposal at the stage of admission itself. Heard the learned counsel appearing on either side and perused the materials placed before this Court.

3. The petitioner's wife had purchased the Plot Nos.13 & 14 by the registered sale deeds dated 05.02.2023 registered vide document No.448 and 449/2003 to an extent of 2400 sq.ft and 2000 sq.ft respectively. After the purchase, the petitioner's wife died. The petitioner and his 2/5

children derive title over the property and they have issued joint patta for the subject land. Now, the petitioner presented the rectification deed including the Survey No.251/6B1A1A1. Originally, the property comprised in S.No.251/6 to an extent of 1.13 acre was sub divided as S.No.251/6B situated at Pithcandarkovil Village, Manachanallur Taluk was purchased by one Kittu vide registered sale deed dated 14.07.1986. Thereafter, the said land was layed out and sub divided into house plots in the year 2002. From the said lay out, the petitioner's wife purchased the Plot Nos.13 & 14 in the year 2003. Therefore, the respondent has rightly directed the petitioner to produce the sale deed which was purchased by the petitioner's wife's vendor dated 14.07.1986 in order to verify whether the petitioner's wife vendor had title over the property in respect of the property comprised in 251/6A since the petitioner now presented the rectification deed for registration to insert the S.F.No. 251/6A.

4. In view of the above, this Court finds no infirmity or illegality in the order passed by the respondent and it is devoid of merits and is liable to be dismissed.

3/5

5. Accordingly, the writ petition is dismissed. The petitioner is at liberty to represent the sale deed for registration along with any correlation of document to substantiate the contention and certified copy of the sale deed dated 14.07.1986. On receipt of the same, the respondent is directed to register the same, if it is otherwise in order. No costs.
