RESPONDENT/REVISION PETITIONER Petition filed praying that in the circumstances stated therein and in the petition filed therewith the High Court may be pleased to permit the petitioner to withdraw the amount with interest from the court deposit in S.T.C.No. 768/2015 on the file of the learned Judicial Magistrate Court No. II, Tiruchirappalli in Crl.M.P. (MD) No. 67/2020 in Crl.R.C. (MD) No. 11/2020 dated 23.01.2020.

PRAYER IN CRL RC(MD) No.11 of 2020:

Pleased to call for the records relating to the Judgment of Conviction and sentence dated 02-03-2019 in Criminal Appeal No.127 of 2018 on the file Learned Sessions Judge, Tiruchirappalli Division, Tiruchirappalli confirming the Judgment of Conviction and sentence dated 25-08-2018 in S.T.C.No.768 of 2015 on the file Learned Judicial Magistrate No.II, Tiruchirappalli and set aside the same.

Order : This petition coming up for orders on this day, upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.SELVAN.T, Advocate for the petitioner and of Mr.M.AASHA, Government Advocate(crl.side) on behalf of the 1st Respondent, the Court made the following order:- The petition has been filed seeking permission to withdraw the amount, which was deposited by the respondent while suspending his sentence by this Court vide order dated 23.01.2020. https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL MP(MD) No.2018 of 2022 2.As directed by this Court, the respondent deposited a sum of Rs.7,00,000/- before the learned Judicial Magistrate Court No.II, Trichy. On such deposit, the sentence which was imposed on the second respondent had been suspended.

3.Considering the above, the petitioner is permitted to withdraw the amount deposited by the respondent in S.T.C.No.768 of 2015, on the file of the learned Judicial Magistrate Court No.II, Trichy, on filing appropriate application before the trial Court. 4.This petition is ordered accordingly.
