ORDER

This Criminal Miscellaneous Petition has been filed to relax the condition No.10(iii) imposed upon Revision Petitioners in Crl.MP(MD)No.11399 of 2025 in Crl.R.C.(MD)No.1167 of 2025, dated 26.08.2025. Condition No.10(iii) reads as under:- "10. ....

(iii) the petitioners shall appear before the trial Court at 10.30 a.m on the first Monday of every English Calendar month until further orders."

2.Heard Mr.K.Rajeshwaran, learned counsel for Revision Petitioners and Mr.P.Kottaichamy, learned Government Advocate for Respondent.

3. Learned counsel for Revision Petitioners submits that Revision Petitioners have been regularly complying with the conditions imposed by this Court dated 26.08.2025 in Crl.MP(MD)No.11399 of 2025 in Crl.RC(MD)No.1167 of 2025. He further submits that as they are senior citizens aged about 73 years and 78 years respectively and suffering from age related ailments, he prays that Condition No. 10(iii) of the order 2/5

dated 26.08.2025 imposed on the Revision Petitioners may be relaxed. He further prays that Revision Petitioners may be directed to appear before the Trial Court once in every three months.

4. Learned Government Advocate for Respondent concedes that Revision Petitioners are regularly complying with the conditions imposed by this Court vide order dated 26.08.2025. However, he objects to the prayer that the appearance of Revision Petitioners before the Trial Court once in every three months and prays that this Court may relax the condition of appearance of Revision Petitioners before the Trial Court once in two months.

5. Taking into consideration the submissions made by learned Counsel on both sides, condition No.10(iii) imposed by this Court in Crl.MP(MD)No.11399 of 2025 in Crl.R.C.(MD)No.1167 of 2025 dated 26.08.2025, is modified as follows:- "10. ....

(iii) Revision Petitioners shall appear before the trial Court once in two months ie.,on the first working day of every alternate month ie., commencing from March 2026, until further orders"

6.With the aforesaid modification, this Criminal Miscellaneous Petition stands ordered.
