To call for the records relating to the judgment dated 13.07.2016 made in CA No.35 of 2015 on the file of Mahila Court/Sessions, Karur, confirming the conviction of the petitioner under sec.138 of the Negotiable Instrument Act and modifying the sentence into 2 months simple imprisonment from the simple imprisonment of 5 months imposed by Fast Track Court at Magistrial Legal of Karur by his judgment of conviction and sentence dated 06.06.2015 made in CC No.546 of 2014, allow this Criminal Revision case.
Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.V.JANAKIRAMULU, Advocate for the petitioner and of MR.S.DEENADHAYALAN, Advocate on behalf of the Respondent the court made the following order:- This is an application for condonation of delay.
2. Heard the learned counsel for the petitioner.
3. Accepting the reasons assigned in the affidavit filed in support of the application, the delay of 173 days in re-presenting Crl.R.C.(MD)SR.No.42277 of 2016 is condoned on condition that the petitioner shall deposit a sum of Rs.2,500/- (Rupees Two Thousand and Five Hundred only) with Gandhi Museum, Madurai, within a period of one week from today and produce a receipt before the Registry. On production of receipt, the Registry is directed to number the https://hcservices.ecourts.gov.in/hcservices/
revision, if the same is otherwise in order, and print the name of Mr.Deenadhayalan for respondent.
