Prayer: Writ Petition filed under Article 226 of Constitution of India, praying to issue a Writ of Mandamus, directing the respondents 1 and 2 to shift the auto rickshaw stand functioning along with pedestrian pathway in front of the petitioner's institute Puliyamoodu - Thiruvattur Road of Attoor Village, Kanyakumari District to Puliyamoodu - Yettacode Road by considering the petitioner's representation dated 30.11.2023 within the time stipulated by this Court.

ORDER

This Writ Petition has been filed to direct the respondents 1 and 2 to shift the auto rickshaw stand functioning along with pedestrian pathway in front of the petitioner's institute Puliyamoodu - Thiruvattur Road of Attoor Village, Kanyakumari District to Puliyamoodu - Yettacode Road by considering the petitioner's representation dated 30.11.2023. 2/5

2. The learned Additional Government Pleader appearing for the respondents 1 and 2 would submit that the Executive Officer, Attoor Municipality has filed a report stating that as per the direction of this Court, auto stand has been removed and re-located.

3. However, the learned counsel appearing for the petitioner would submit that even though the auto stand has been removed, still some auto drivers are parking their autos in front of the petitioner's Technical Institute.

4. I have given due consideration to the submissions made on either sides.

5. In the event, if any auto is parked in front of the petitioner's Technical Institute, the petitioner may take a photograph and produce the same before the third respondent Police along with complaint. On such complaint, the third respondent is directed to seize the auto and take steps to file First Information Report against the owner and driver of the auto. The third respondent is also directed to forward the complaint to the Regional Transport Office, Martham, Kanyakumari District, in which case, the concerned Authority is directed to cancel the licence of the driver of the auto. 3/5
