RESPONDENTS/PETITIONERS Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to Dispense with the Personal Appearance of the Petitioner pending trial in D.V.Case No.3 of 2016 on the file of the Learned Judicial Magistrate, No.2, Ramanathapuram till the disposal of the instant Criminal Original Petition and thus render justice. Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.T.

THIRUMURUGAN, Advocate for the petitioner and of M/S.K.BHARATHI, Government Advocate (Crl.Side) on behalf of the Respondents the court made the following order:- The learned counsel appearing for the petitioner would submit that already the respondents herein, have filed a case in M.C.No.29 of 2016, before the learned Chief Judicial Magistrate, Ramanathapuram and in that case, the petitioner was ordered to pay a sum of Rs.8,500/- (Rupees Eight Thousand and Five Hundred only) per month towards maintenance for the first and second respondents. Against the said order, the petitioner herein, has preferred a revision in Cr.R.C.No.729 of 2017. He further submitted that as per the order passed by this Court in the said criminal revision, the petitioner has deposited the entire arrears of Rs.85,000/-(Rupees eighty five thousand only).

2. The learned Counsel for the petitioner further submitted that the respondents herein, have filed another case under the Domesic Violence Act in D.V.C.No.3 of 2016, before the learned Judicial Magistrate No.2, Ramanathapuram. In that case also the respondents are claiming maintenance and other reliefs. He further submitted that the petitioner is a physically challenged person having 70% of disability and he has not able to attend the Court regularly and hence, he is seeking to dispense with his personal appearance before the Trial Court.
