Respondents Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, by directing the first respondent to conclude the un-dated appeal petition preferred by the petitioner and six others pending in arbitration proceedings in Na.Ka.No.C4-4234-2019 dated 23.01.2020 within a time frame as fixed by this Court.

ORDER

Heard Mr.N.Anandakumar, learned counsel for the petitioner and Mr.D.Ghandiraj, learned Special Government Pleader who takes notice for the respondents.

This Writ Petition has been filed in the nature of Mandamus seeking a direction to the first respondent/the District Collector, Trichirappalli District to proceed further with the arbitration proceedings in Na.Ka.No.C4-4234-2019 dated 23.01.2020, filed by the petitioner herein consequent to, the dissatisfaction over the award amount granted pursuant to acquisition of the lands by the second and third respondents.

3. Learned counsel stated that the acquisition proceedings had been completed in the year 2018. But raising objections over https://hcservices.ecourts.gov.in/hcservices/ 1/2

W.P.(MD).No.2346 of 2022 the quantum of award granted, they had, as provided by law, approached the first respondent/the District Collector and had initiated the arbitral proceedings aforementioned.

4. Mr.D.Ghandiraj, learned Special Government Pleader pointed out that the first respondent had also issued notice for the parties to appear for an enquiry and stated that the enquiries are ongoing.

5. A direction is given to the first respondent to bestow attention on the enquiry and complete the same within a period of sixteen (16) weeks from the date of receipt of a copy of this order. Let normal procedure relating to issuance of notice and hearing the parties be followed during the course of enquiry.

6. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
