ORDER : The Court Made the following order :- The petitioners, who are arrayed as accused Nos.1 to 8, apprehend arrest at the hands of the respondent police for the alleged offences punishable under Sections 147, 364(A), 294(b), 323, 324 and 506(ii) of IPC, in Crime No.453 of 2015 on the file of the respondent police and hence, seek anticipatory bail.
2.According to the defacto complainant viz.,Sasikumar, he along with his friends Indiraj, Arun, Satheesh, Karthick and Ignesh received Rs.12,00,000/- from the accused assuring employment in a Bank and issued a fake appointment orders and on 24.09.2015, the accused by giving promise to pay balance of Rs.60,000/- took him in a lonely place and beaten him and also threatened him with dire consequences. 3.The learned counsel for the petitioners submitted that the petitioners have been falsely implicated in this case and it is further submitted that, even as per the complaint, the defacto complainant received Rs.12,00,000/- by giving false promise of securing employment in the Bank and due to his non-fulfilment of the assurance, he lodged a false complaint against the petitioners.
4.The learned Government Advocate (Crl.side) submitted that the petitioners have no bad antecedents and the accused have kidnaped the defacto complainant and demanding their money given for securing the employment.
5.Considering the above facts, this Court is inclined to grant anticipatory bail to the petitioners, with certain conditions. Accordingly, the petitioners are ordered to be released on bail in the https://hcservices.ecourts.gov.in/hcservices/
event of arrest or on their appearance before the learned Judicial Magistrate No.II, Thoothukudi and on each of them executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned and on further condition that the petitioners shall appear before the respondent police as and when required. The petitioners shall comply with the condition stipulated under Section 438 Cr.P.C. scrupulously.
6. The petitioners shall appear before the concerned Magistrate within a period of 15 days from the date on which the order copy made ready, failing which, the petition for anticipatory bail stands dismissed. sd/- 05/10/2015 / TRUE COPY / Sub-Assistant Registrar (C.S.)
