ORDER

This petition has been filed seeking a direction to the respondents 1 & 2 to provide police protection to the life and limb of the petitioner and her family from the 3rd respondent and his henchmen based on the petitioner's representation dt. 19.12.2025.

The learned counsel appearing for the petitioner submitted that the due to the prevailing threat from the neighbour, who is arrayed as the third respondent herein, the petitioner has sought for police protection from the second respondent Police. Earlier, at the instance of the petitioner, two FIRs have been registered as against the third respondent. In this regard, the third respondent has vengeance against the petitioner and is subjecting the petitioner, who is a senior citizen lady to harassment. Hence, the petitioner seeks police protection.

3. The learned Government Advocate appearing for the respondent police submitted that there is a land dispute between the petitioner and her neighbours. When the petitioner and her family came 2/6

to their own house at native place for celebrating pongal festival, the dispute arose and the petitioner's son gave a complaint. Pursuant to the same, an FIR has been registered as against four persons, among whom, three of them were arrested and one person got anticipatory bail. Now, they have gone back after vacation

4. Heard the learned counsel on either side and carefully perused the materials available on record. Since no adverse order is proposed to be passed against the third respondent, notice to him is dispensed with.

Considering the submission made by the learned Government Advocate, threat as submitted by the learned counsel for the petitioner had arisen only during the visit to her native during Pongal vacation and since they have left for some other place where they are regularly dwelling presently, there is no threat which is prevailing as against the petitioner. Recording the submission of the learned Government Advocate, the petitioner is given liberty to approach the second respondent police at any point of time, whenever a threat arises. 3/6

6. At this juncture, the learned counsel appearing for the petitioner sought police protection for the purpose of putting up a compound wall in her property.

Considering the said request, the second respondent is directed to afford appropriate police protection on suitable application made by the petitioner by paying necessary fees in terms of GO.Ms.No.139, Home (Pol-VIII) Department, dated 04.03.2019. It is also directed that the enquiry is to be conducted after putting on notice the petitioner and all necessary parties.

8. With the above direction, this criminal original petition stands allowed.
