For Respondent : Mr.A.Robinson, Government Advocate (Crl.Side) For Intervener : Mr.R.Anand, Advocate PETITION FOR ANTICIPATORY BAIL Under Sec.438 of Cr.P.C PRAYER :- for Anticipatory Bail in Crime No.45 of 2019 on the file of the respondent police.

ORDER : The Court made the following order :- Heard the learned senior counsel appearing for the petitioners, the learned counsel appearing for the intervener and the learned Government Advocate (Crl. Side) appearing for the respondent.

2. The petitioners apprehending arrest at the hands of the respondent police for the offences under sections 120(b), 406, 420 and 506(i) of I.P.C., in Crime No.45 of 2019 on the file of the respondent police, seek anticipatory bail.

3. The learned counsel appearing for the defacto complainant states that a sum of Rs.15,00,000/- has already been paid and a further a sum of Rs.35,00,000/- is to be paid. It appears that the petitioner has agreed to pay the said amount in a day or two.

4. The learned senior counsel appearing for the petitioner states that the undertaking to pay the balance amount of https://hcservices.ecourts.gov.in/hcservices/ 1/2

CRL OP(MD). No.2190 of 2020 Rs.35,00,000/- will be duly honoured. Upon receipt of a sum of Rs.50,00,000/-, the defacto complainant is directed to intimate the Inspector of Police, District Crime Branch, Tirunelveli District about the same and also give his no objection for closing the case. Thereupon, the respondent shall file the final report dropping further action in the matter.

5. Since the case is likely to be dropped, the accused need not have any apprehension of arrest. If the undertaking given before this Court is not honoured within a period of seven days from the date of receipt of a copy of this order, the order now passed will stand recalled and the criminal original petition will stand dismissed.

6. With these observations, this criminal original petition is disposed of.
