ORDER

The petitioner is an accused in SplCC No.1 of 2021. He has approached this Court seeking a a direction to the Chief Judicial Magistrate, Theni to expedite the trial in SplCC No.1 of 2021.

2.This Court by its earlier order dated 30.01.2025 called for a report from the trial court as to the stage of the trial in SplSCNo.1 of 2021. The learned Chief Judicial Magistrate, Theni has submitted a report that eighteen witnesses have already been examined and five more witnesses have to be examined. However the petitioner / A2 has not cross examined the witnesses PW1, PW.5, PW.11 and PW.6.

3.Considering the conduct of this petitioner in not cross examining the witnesses, who are available for trial, this Court is not inclined entertain this petition on the grounds raised by the petitioner. Accordingly, this criminal original petition is dismissed. 14-02-2025 DSK To
