ORDER

*********** This is an application filed by the petitioner seeking direction to the third respondent to register the complaint based upon the copy of the complaint lodged by the petitioner, dated 20.08.2015.

2.The learned Government Advocate (crl. side) would submit that the petition contained only with vague and general allegations and did not make out any cognizable offence, but however, it has been forwarded to the Chief Secretary to Government as per the instructions issued in paragraph No.10(2) of the Manual of the Directorate of Vigilance and Anti Corruption, Chennai.

3.Whomsoever, conduct enquiry, based upon the direction of the Chief Secretary, shall conduct enquiry/investigation and if the enquiry report discloses commission of any cognizable offence, the enquiry officer shall follow the dictum laid down in the judgment of the Hon'ble Supreme Court in Lalita Kumari vs. Govt. of U.P. & others [2013 (4) Crimes 243 (SC)]. If the enquiry is otherwise, the copy of the enquiry report shall be furnished to the petitioner and on such receipt of the report, it is open to the petitioner to take further action in accordance with law. 4.The Criminal Original Petition is disposed of accordingly.
