ORDER
This writ petition has been filed for issuance of writ of mandamus directing the 2nd respondent / Appellate Authority to dispose the petitioner's Appeal dated 09.10.2023 pending before him in accordance with law within the time stipulated by this Court.
2. According to the petitioner, the petitioner purchased plot Nos.34 and 35 to an extent of 7 cents 36 sq.ft, through a registered sale deed dated 19.03.2001 and the petitioner is in possession and enjoyment of the same. Patta and chitta stands in the name of her vendor, namely Kannan. Therefore, the petitioner made an online application on 03.05.2023 for patta transfer. In the meanwhile, the petitioner filed a writ petition in WP(MD)No.16050 of 2023 before this Court to consider the application, which was also rejected by the third respondent. Challenging the same, the petitioner preferred a statutory appeal before the first respondent on 09.10.2023, which has been forwarded to the second respondent. Since the same is still pending, the petitioner came before this Court for early disposal of the appeal. 2/4
3. The learned Special Government Pleader appearing for the official respondents would submit that the petitioner's appeal will be disposed of by the second respondent in accordance with law within the time stipulated by this Court.
4. Heard the learned counsel appearing for the petitioner and the learned Special Government Pleader appearing for the respondents.
5. In view of the above said submission, this Court, without expressing any opinion on the merits of the matter, directs the second respondent to dispose of the Appeal dated 09.10.2023 filed by the petitioner and pass appropriate orders on merits and in accordance with law, after affording an opportunity of hearing to the parties concerned, within a period of twelve (12) weeks from the date of receipt of a copy of this order.
6. With the above direction, the writ Petition stands disposed of. No costs.
