PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, forbearing the Respondents No.2 and 4 from dispossessing the Petitioner with respect to the Property comprised in Survey No.469 Part now wrongly classified as Survey No.469/1A3 bearing Door No. 4-8-103, Kottaivasal Street, Puliyarai Post, Shenkottai Taluk, Tenkasi District which includes house property and the land property to an extent of 2 Acres 64 Cents not otherwise than due process of law beside directing the Respondents No.1 and 3 to conduct an enquiry based on the petitioner's representation dated 29.12.2025 as per the procedures contemplated under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007, within time frame as fixed by this Court.

ORDER

The present writ petition has been filed forbearing the respondents 2 and 4 from dispossessing the petitioner with respect to the property comprised in Survey No.469 part now wrongly classified as Survey No.469/1A3 bearing Door No.4-8-103, Kottaivasal Street, Puliyarai Post, Shenkottai Taluk, Tenkasi District and the petitioner has also prayed for conducting an enquiry based upon her representation dated 29.12.2025 as per the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.

2. Heard the learned Counsel appearing for the petitioner as well as the learned Counsel appearing for the respondents 6 to 9.

3. The learned Counsel appearing for the petitioner submits that she is the owner of the property and she has never sold it to anyone of the private respondents. However, on the strength of certain documents, the private respondents are trying to dispossess her with the help of respondents 2 to 4, who are the revenue as well as the police officials. 3/6

4. It is settled position of law that the Government officials cannot interfere in the civil dispute.

5. As far as the prayer of the petitioner with regard to an enquiry based upon the representation of the petitioner is concerned, this Court is inclined to direct the 2nd and 4th respondents not to interfere in the civil dispute. As far as the enquiry under the Maintenance and Welfare of Parents and Senior Citizens Act 2007, is concerned, the petitioner is directed to approach the competent authority with an appropriate application.

6. With the above said observations, this writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is also closed. 03.02.2026 NCC : Yes/No Index : Yes/No Internet: Yes/No RJR 4/6
