Criminal Original Petition filed u/s.528 BNSS to direct the respondent herein to file a charge sheet in Crime No.3/2021 on the file of the Inspector of Police, Vigilance and Anti Corruption, Dindigul, within reasonable time as may be stipulated by this Court.

O R D E R

(1)The petition is filed by the petitioner to direct the respondent herein to file the charge sheet in Cr.No.3/2021 pending on the file of the Inspector of Police, DV&AC, Dindigul, within a reasonable time to be fixed by this Court. (2)The petitioner, during his tenure as Assistant Manager in Arulmighu Dhandayuthapani Swamy Tirukoil, Palani, was placed under suspension and was not allowed to retire from service on 29.05.2025, for acquisition of disproportionate assets. A FIR was registered against the petitioner on 10.03.2021, for the offences u/s.13[2] read with 13[1][d] of the Prevention of Corruption Act, 1988, as amended by Prevention of Corruption [Amendment] Act, 2018, and under Section 109 of IPC. Though the investigation commenced as early as in 2021, the final report was not filed despite the lapse of four years. The petitioner, therefore was constrained to file the above petition for the aforesaid relief.

(3)The learned Additional Public Prosecutor, accepting notice on behalf of the respondent, submitted that a period of three months may be granted to file the final report.

(4)In view of the submission made by the learned Additional Public Prosecutor, the respondent police is directed to file the Final Report in Crime No,3/2021, within a period of three months from the date of receipt of a copy of this order. (5)The petition is ordered accordingly.
