Prayer : Writ Petition filed under Article 226 of the Constitution of India, for issuance of a Writ of Certiorarified Mandamus, to call for the records pertaining to the impugned notice issued by the third respondent in Proceedings Na.Ka.A4/1683/2025 dated 22.01.2026, quash the same as illegal and consequently direct first to fifth respondents to consider petitioner's objections dated 24.01.2026 and pass orders on merits after affording the petitioner an opportunity of hearing within a time frame to be fixed by this Court.

O R D E R

In this Writ Petition, the petitioner has challenged the survey notice issued by the third respondent dated 22.01.2026.

2. With the consent of the parties, this Writ Petition is taken up for final disposal at the admission stage itself.

3. It is the case of the petitioner that there is a civil dispute between the parties with regard to title to the property in O.S.No.4 of 2025 on the file of the District Munsif Court, Manamadurai, Sivagangai District and Page No. 2 of 5

such an issue cannot be decided by the Surveyor or the Tahsildar while conducting enquiry.

4. Admittedly, there is a civil dispute between the parties and a suit has also been instituted with regard to title to the property. In the event of such a dispute, the issues have to be agitated before the competent civil court. Any dispute relating to title cannot be considered or decided by the Surveyor or the Tahsildar. The petitioner has already filed his objection in this regard and the same shall be considered by the competent authority. It is made clear that if the issues raised by the parties are pending adjudication before the civil court, the said issues shall be determined by the civil court and the order of the civil court shall be followed by the concerned authorities.
