ORDER

The learned Counsel for the Petitioner submits that the Petitioner has filed this Writ Petition seeking a direction against the respondents 1 and 2 to grant him permission to conduct the temple festival of Sri Sangaiyasamy and Sri Karuppasamy situated at Atchankulam Village, Thiruppuvanam Taluk, Sivagangai District is scheduled to be held on 10.03.2024 and 11.03.2024.

The learned Additional Public Prosecutor on instructions from the Respondents 1 and 2 would submits that individuals are not permitted to conduct the festival and the Respondents 1 and 2 sought the names of the committee members of the festival committee of the temple of Sri Sangaiyasamy and Sri Karuppasamy. The learned Additional Public Prosecutor would further submit that on such production, the Respondents are ready to grant permission subject to the Circular issued by the Director General of Police, Tamil Nadu, Chennai, in Rc.007301/Genl.I(1)/2019, dated 09.04.2019 and also on undertaking to pay the cost for police protection as per the abovesaid Circular. 2/5

On considering the rival submissions, the Petitioner is directed to give a fresh representation based on the names of the organizing committee members of temple festival of Sri Sangaiyasamy and Sri Karuppasamy, so that any untoward incidents can be avoided in the light of the law and order situation regarding the temple festival and also organizing committee members are duty bound to pay the necessary fees as per the Circular issued by the Director General of Police, Tamil Nadu, Chennai, in Rc.007301/Genl.I(1)/2019, dated 09.04.2019 regarding police protection. The Respondents 1 and 2 are directed to consider a fresh representation if it is given in the name of the organizing committee containing the names of the members of the organizing committee of the temple festival of Sri Sangaiyasamy and Sri Karuppasamy. On receipt of such representation, the same shall be considered by the Respondents 1 and 2 within a period of one week from the date of receipt of a copy of this order.
