Writ Petition is filed under Article 226 of the Constitution of India, praying this Court To issue a Writ of Certiorarified Mandamus, calling for the records relating to the order of rejection in Letter No. MH 26/MDU-015/06 dated 13/04/2007 on the file of the 3rd respondent quash the same and direct the to confirm the sale of the commercial site Code No. MDU-015 in favour of the petitioner in pursuance of sealed tender cum open auction dated 08/02/2007 after following the procedure laid down under law and pass such further or other orders and thus render justice. learned counsel for the second respondent that already two connected Writ Appeals arising out of the same Common Order passed by the learned Single Judge was dismissed by this Court. The learned counsel for the second respondent submitted on the other day that he will produce the copy of those judgements. Today, the learned counsel has produced the copy of those judgements dismissing the Writ Appeals arising out of the same common order passed in the Writ Petitions.

2.Today, when the matter is listed again for further hearing,there is no representation for the appellant once-again. Hence, there is no point in keeping the appeal pending. 3.In view of the above, this Writ Appeal is dismissed. No costs. Consequently, connected Civil Miscellaneous Petitions are dismissed.
