Prayer: This Criminal Original Petition is filed under Section 482 of Cr.P.C., to call for records pertaining to the First Information Report in Crime No.9 of 2021, dated 17.07.2021 on the file of the first respondent and quash the same as illegal as against the accused Nos.1 to 3.

O R D E R

The Criminal Original Petition has been filed to quash the FIR registered in Crime No.9 of 2021 on the file of the first respondent for the offences under Sections 294(b), 498(A), 506(1) of Indian Penal Code.

2.The prosecution case is that on 27.05.2020, the first petitioner and the second respondent got married. Second respondent parents gave 12 1⁄2 sovereign jewels to their daughter, 3 sovereign gold chain to the first petitioner and also gifted two wheeler and other home appliances as dowry. After that, second and third petitioners demanded additional dowry from the second respondent parents. The second petitioner herein used filthy words against the second respondent by consuming alcohol. Crl.O.P(MD)No.2579 of 2022 respondent from the matrimonial home. Then, they lodged false complaint before the respondent police and the District Collector. In that regard, the FIR had been registered in Crime No.9 of 2021 on the file of the first respondent.

3.The learned Counsel appearing for the petitioners would submit that the petitioners are innocent and they have not committed any offence as alleged by the prosecution. Without any base, the first respondent police registered a case in Crime No. 9 of 2021 for the offences under 294(b), 498(A), 506(1) of Indian Penal Code against the petitioners.

4.The learned Additional Public Prosecutor would submit that the first respondent completed the investigation and filed the final report as early as on 17.07.2021 on the file of the Judicial Magistrate, Keeranur.

5.In view of the same, this Criminal Original Petition stands dismissed as infructuous.

Consequently, the connected Miscellaneous Petition is also closed.
