ORDER : The Court Made the following order :- The petitioners are in judicial custody since 04.10.2018 for the offences punishable under Section 379 I.P.C and Sections 21(4) of Mines and Minerals (Development & Regulation) Act, 1957, in Crime No.126 of 2018 on the file of the respondent police. They seek bail. 2.Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent. 3.The case of the prosecution is that the petitioners were illegally transported the river sand by using vehicle. 4.The learned counsel for the petitioners would submit that the petitioners have not committed any offence and they have been falsely implicated in this case. The petitioners are in judicial custody from 04.10.2018. They are innocent person. Co-accused (A4) was already released on anticipatory bail. Hence, they prays for grant of bail to the petitioners.

5. The learned Additional Public Prosecutor for the respondent would submit that the petitioners have illegally transported six units of river sand without getting permission and the property was recovered.

6.Considering the above facts and circumstances and also considering the period of incarceration of the petitioners, this Court is inclined to grant bail to the petitioners. Accordingly, the petitioners are ordered to be released on bail subject to the following conditions:

(i) the petitioners shall execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate No.IV, Trichy.

(ii)the petitioners shall appear before the respondent police daily at 10.30 a.m. until further orders.
