ORDER

This Writ Petition is filed, seeking to quash the impugned order of the second respondent dated 25.01.2025, rejecting the petitioner's application for electricity connection.

2.Heard the learned counsels on either side and carefully perused the entire materials available on record.

3.The petitioner made an application in online mode for single phase temporary electricity connection service for construction on 24.01.2025 with respect to the property in Plot no.9, which is comprised in S.Nos.11/6B1, 12/18, 12/22, 23/8, 11/9, 11,12, 12/19, 25, 23/9, 10, 11, 15 to 18, 25, 26 and S.No.23/37 in Athalaipatti Village, Kalanivasal Group, Sankarapuram Panchayat, Sakkottai Union, Karaikudi Taluk. The same was rejected on the ground that the same is situated near sambai ootru. 4.However, this matter is no more res integra. This Court has dealt with the similar case in W.P.(MD)No.23738 of 2024 dated 04.10.2024 and 2/5

the relevant portion of the same is extracted as follows:- "6.The issue on hand has already been dealt with by this Court in W.P.(MD)No.4129 of 2022 [S.Nitheshraj vs. The District Collector and others].

7.Following the same, this writ petition is allowed and the order passed by the second respondent dated 21.09.2024 is set aside. The second respondent is directed to provide electricity service connection to the subject property subject to the fulfilment of the other usual formalities as expeditiously as possible. No costs. Consequently, connected miscellaneous petition is closed." 5.Fully fortified by the aforesaid judgment, this Court hereby quash the impugned order passed by the second respondent. The second respondent is directed to provide electricity connection to the subject property, if the petitioner's application is otherwise in order. 6.Accordingly, this Writ Petition is disposed of. No costs.
