Prayer in WP(MD).No. 13627/ 2014 :

Writ Petition is filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records relating to the Impugned Proceedings of respondent in vide Na.Ka. N:o. F2/2175/2010, dated 22.07.2014 relating Shop No. 15 and quash the same and consequently direct the respondent to assess the real status of the building in which disputed shop in question is situated and ascertain as to whether it requires demolition and reconstruction and further to direct the respondent to grant sufficient time to vacate the premises in case if they comes to the conclusion based on materials that the said building requires demolition and reconstruction and further direct the respondent to accord priority to the petitioner in letting out the shop after such demolition and reconstruction.

[Order of the Court was made by M.SATHYANARAYANAN, J.] The learned Counsel appearing for the appellant, on instructions, seeks permission of this Court to withdraw this writ appeal and he has also made and endorsement to that effect.

2. In view of the endorsement made by the learned Counsel appearing for the appellant, the writ appeal is dismissed as withdrawn. No costs. Consequently, the connected Miscellaneous Petition is also dismissed.
