Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused No.4, in Crime No.232 of 2014 on the file of the respondent police, apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 392 read with 302 of the Indian Penal Code and hence, seeks anticipatory bail.
2. The case of the prosecution is that the petitioner and others including the son of the deceased murdered the deceased and robbed 'Thandati' from the deceased ear and one chain. One of the accused Marimuthu was arrested on 17.05.2015 and subsequently one Japan @ Nallameetan and Raja @ Rocket Raja were also arrested and based on their confession and investigation, it was found that the petitioner was also involved in the crime.
3. The case of the petitioner is that the petitioner is an innocent person and he is nothing to do with the murder. According to the petitioner, there is previous enmity between the petitioner's brother and respondent police, therefore, his name has been falsely implicated in this case.
4. The learned Government Advocate (Criminal Side) filed his counter and contended that Accused No.1-son of the deceased engaged the petitioner and others and murdered the deceased. Accused No.1 gave Rs.20,000/- to the petitioner and others for murdering his https://hcservices.ecourts.gov.in/hcservices/
mother. The other accused are still in custody and hence, the custodial interrogation of the petitioner is necessary. If the petitioner is released on bail, he will abscond and investigation will be affected.
