ORDER : The Court Made the following order :- The petitioner, who is arrayed as sole accused apprehends arrest at the hands of the respondent police for the alleged offences punishable under sections 468, 471 and 420 of IPC, in Crime No.30 of 2015 on the file of the respondent police and hence, seeks anticipatory bail. 2.According to the de-facto complainant, the accused was functioning as Secretary of DSV Primary School at Perunazhi in Ramanathapuram District and he forged the signature of the School Committee members and mortgaged the school property to an extent of 3674 sq. feet to one R.Gunasekaran and obtained a loan of Rs,.
4,30,000/-. 3.The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has nothing to do with the alleged commission of the offence. The learned counsel further submitted that the petitioner was already granted anticipatory bail by this court in Crl.O.P(MD)No.8962 of 2015, dated 07.07.2015, but he could not surrender and furnish the sureties in time before the court concerned and therefore, he filed application for extension of time before this court and that was also allowed on 31.07.2015 and even thereafter also, he could not be able to execute the sureties before the court concerned and hence, the petitioner has filed this petition seeking for anticipatory bail.
4.Heard the learned Government Advocate (Criminal side) appearing for the respondent.
5.Considering the above facts, this court is of the view that this second anticipatory bail petition is not maintainable. Hence, this petition is dismissed as not maintainable.
