quash the same with regard to disqualification of the petitioner's bid and in consequence thereof declare the petitioner's bid as eligible for consideration along with that of the 3rd respondent and open the price bid of the petitioner in Tender notice No.46/2024-25/HDO dated 10.10.2024 issued by the 1st respondent.

ORDER

The petitioner challenges the rejection of his technical bid submitted pursuant to the tender notification dated 10.10.2024 issued by the first respondent, inviting bids for special repairs to Government roads under the Keeranur (H) C & M Sub-Division (Try-116). One of the eligibility conditions prescribed in the tender document was that the bidder should own a Central Mix Plant. 2.The petitioner submitted his bid. However, his technical bid was rejected on the ground that the Central Mix Plant relied upon by him had been sold to one Veeramani and, therefore, the petitioner was no longer its owner and was ineligible to participate in the tender process. The petitioner disputes the said finding and contends that the Central Mix Plant has not been sold and continues to remain under his ownership.

4.Heard the learned counsel appearing on either side. 5.It is seen that the tender period has already expired. In view of the same, no effective relief can now be granted and nothing survives for adjudication in the present writ petition. 6.However, it is made clear that if the petitioner participates in any future tender involving the same work, his bid shall be considered independently and on its own merits, without reference to the impugned rejection of his earlier technical bid. The authorities shall evaluate his eligibility strictly on the basis of the documents produced by him regarding the ownership of the Central Mix Plant. 7.Accordingly, the writ petition stands dismissed.
