PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C. praying to direct the second respondent to file a final report in Crime No.343 of 2017 within a time period stipulated by this Honourable Court.

ORDER

This petition has been filed seeking direction to direct the second respondent to file a final report in Crime No.343 of 2017 within a time period stipulated by this Honourable Court.

2. The learned counsel for the petitioner would submit that though the complaint has been given in the year, 2017 the respondent police did not complete the investigation and filed the final report before the concerned court.

3. Today when the matter is taken up for hearing the learned Additional Public Prosecutor would submit that based on the complaint given by the defacto complainant the respondent police conducted enquiry and closed the complaint as ' Further Action Dropped'.

4. At this juncture the learned counsel for the petitioner would submit that the petitioner was not served with copy of the final report.

5. Recording the aforesaid submission, this Criminal Original Petition is closed. However the respondent police is directed to serve RCS notice to the defacto complainant and on receipt of the RCS notice the petitioner is at liberty to file a protest petition before the concerned jurisdictional Magistrate.
