The petitioner seeks transfer of investigation. The petitioner alleges that on 19.01.2020 at about 10.30 pm. when he was returning home in his two wheeler, the accused coming in the opposite direction in the two wheeler, dashed against him and caused him injuries. In this regard, Crime No.9 of 2020 was registered for the offences under Sections 294(b), 324 and 506 (ii) of IPC against certain named accused. The petitioner alleges that the third respondent is indifferent in the matter of investigation. 2.The learned Government Advcoate states that the third respondent intends to close the case as mistake of fact. https://hcservices.ecourts.gov.in/hcservices/ 1 / 2

Crl.O.P.(MD)No.2211 of 2020 3.I make it clear that before the third respondent files the final report before the jurisdictional Court, the same will be duly vetted by the second respondent herein. The petitioner's right to file a protest petition or private complaint is ofcourse left intact.
