Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus, to direct the respondents 1 and 2 to pass appropriate orders by changing the status of Panchayat Union Middle School, Kurangani Village in Bodinayakkanur Taluk, Theni District as plain area school instead of hill area school based on the proposal sent by the third respondent dated 05.05.2020 in Na.Ka.No.436/A2/2020 forthwith in accordance with law.

ORDER

This Writ Petition has been filed for a Mandamus seeking for a direction to the respondents 1 and 2 to pass appropriate orders by changing the status of Panchayat Union Middle School, Kurangani Village, Bodinayakkanur Taluk, Theni District as plain area school instead of hill area school based on the proposal sent by the third respondent dated 05.05.2020.

2. It is the case of the petitioner that even though a proposal was sent by the third respondent on 05.05.2020 to declare the aforesaid Panchayat Union Middle School as plain area school instead of hill area school, till date, the proposal has not been implemented.

3. Today, Mr.N.GA.Nataraj, learned Government Advocate appearing for the respondents has placed before this Court, a proposal which has been sent by the second respondent, dated 29.12.2021, for recognizing the petitioner's school as plain area school instead of hill area school. The said proposal is recorded.

4. Learned Government Advocate, on instructions, would further submit that, within a period of two (2) months from the date of receipt of a copy of this order, the proposal to recognize the Panchayat Union Middle School, Kurangani Village, Bodinayakkanur Taluk, Theni District as plain area school instead of hill area school, will be implemented. The said undertaking is recorded.

5. In terms of the aforesaid undertaking, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition stands closed.
