CRIME NO.113 OF 2016. ... RESPONDENT/RESPONDENT Petition praying that in the circumstances stated therein and in the petition filed therewith the High Court will be pleased to relax the condition imposed in Crl.M.P.No.970 of 2017 in Crl.O.P.No.13292 of 2016 dated 06.02.2017 that the petitioners to appear before the respondent police weekly once i.e. on every Saturday at 10.30 a.m. for a period of four weeks and thereafter as and when requred.
Order : This petition coming on for orders upon perusing the petition filed in support thereof and upon hearing the arguments of M/S.A.HAJA MOHIDEEN, Advocate for the petitioner and of MR.P.KANDASAMY, Government Advocate (Crl.side) on behalf of the Respondent the court made the following order:- The learned counsel for the petitioners is present. 2.This Court by order dated 29.08.2016 granted anticipatory bail in Crl.O.P.(MD)No.13292 of 2016 directed the petitioner to report before the respondent Police daily at 10.30 am until further orders. Subsequently, the said condition was modified by this Court in Crl.M.P.(MD)No.9619 of 2016 on 05.10.2016 on condition that the petitioner shall appear before the respondent Police weekly once ie., every Monday at 10.
30 am until further orders and thereafter, the petitioner filed another petition in Crl.M.P.(MD)No.10732 of 2016 for relaxation. This Court by order dated 07.11.2016 directed the petitioner to appear before the respondent Police once in a month ie., the first working day of every English Calender month at 10.00 am until further orders and also as and when required. Again the petitioner filed a petition in Crl.M.P.(MD)No.970 of 2017 for https://hcservices.ecourts.gov.
relaxation and by order dated 06.02.2016, this Court directed the petitioner to appear before the respondent Police every Saturday at 10.30 am for a period of 4 weeks and thereafter as and when required.
3.The present petition is filed for relaxing the earlier modified conditions.
4.Considering the facts and circumstances of the case and considering the fact that the offence is under Section 420 IPC, this Court is not inclined to relax the earlier condition since earlier, the petitioner was directed to appear before the respondent police weekly once ie. on every Saturday at 10.30 am for a period of 4 weeks and thereafter, as and when required. Accordingly, this petition is dismissed.
