ORDER : The Court Made the following order :- The petitioner, who was arrested and remanded to judicial custody since 28.03.2019 for the offences punishable under Sections 294(b), 376,417, 120(B) and 506(i) of IPC Crime No. 3 of 2019, on the file of the respondent police, seeks bail..
2. The learned counsel for the petitioner would submit that the offence committed is in Kanchipuram District and the complaint was filed in Virudhunagar District. Immediately after that the second remand must be done before the Jurisdictional Magistrate where the offence is committed . Hence the second remand extension done by the Jurisdictional Magistrate is illegal.
3. The learned counsel appearing for the petitioner seeks the permission of this Court to withdraw this petition and has also made an endorsement to that effect in the petition. the petitioner, this petition is dismissed as withdrawn with liberty to the petitioner to file appropriate petition before the appropriate Court.
