Side) PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner, who is arrayed as accused, apprehend arrest at the hands of the respondent for the alleged offence punishable under Section 302 of IPC in Crime No.196 of 2019, seek anticipatory bail.

2. The case of the prosecution is that the defacto complainant and the petitioner are known to each other and there was a money dispute among them. On earlier occasion the petitioner agreed to pay the amount and later refused to repay the same and when the same was questioned, the petitioner attacked the defacto complainant in chest , thereby he sustained injuries and died in the hospital.

3. The learned counsel for the petitioner would submit that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution. He would also submit that due to some wordy quarrel they both pushed each other thereby he fell down and succumbed to injuries. Hence prayed for anticipatory bail.

4. The learned Government Advocate (Crl.Side) would submit that there are nine cases pending against the petitioner and the offence committed by the petitioner is heinous is nature and opposed for grant of anticipatory bail.

5.Taking into consideration the facts and circumstances of the case and also considering the fact there are previous cases pending against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
