ORDER
Mr.T.Amjadkhan, learned Government Advocate takes notice for the first respondent. By consent of both the parties, this writ petition is taken up for final hearing at the admission stage itself.
2. This Writ Petition has been filed seeking to remove the names of second and third respondents from the legal heir certificate bearing No.Pa.Mo.No.789/2008 dated 20.02.2008 issued by the 1st respondent by considering the petitioner's representation dated 11.12.2024.
3. Heard the learned counsels on either sides and carefully perused the materials available on record.
4. The contention of the petitioner is that the second and third respondent are the children born through the second wife of the petitioner's husband. The first respondent has issued a legal heir certificate incorporating the names of the second and third respondents as legal heirs of the deceased father. Hence, the petitioner made a representation to the first respondent, seeking to remove the names of the second and third respondent in the legal heir certificate which was 2/4
issued in the year 2008 on the basis of a circular issued by the Principal Secretary/Commissioner of Revenue Administration, dated 09.08.2017. In such case, the petitioner ought to have challenged the aforesaid legal heir certificate.
5. Accordingly, giving liberty to the petitioner to challenge the said legal heir certificate, this Writ Petition is disposed of. No costs. 30.01.2025 NCC : Yes / No Index : Yes / No jbr TO:- The Tahsildar, Srirangam Taluk, Trichy District.
